JLRA Terms of Sale and Privacy Disclosure

General Conditions
Your contract is with Jaguar Land Rover Australia Pty. Ltd. (JLRA) Level 1, 65 Epping Road, North Ryde 2113, NSW, Australia, trading as Jaguar Australia and Land Rover Australia. In case of complaint please contact the JLRA Information Centre on 1300 882 610 or via email to info@jaguar-merchandise.com.au.

Our Order and Delivery Service

Customers wishing to purchase products from the JLRA Online Shop (the “Online Shop”) must add the items to the Online Shop ‘Basket’ and enter their billing details at ‘Checkout’ and fully comply with the instructions indicated therein.

As confirmation of acceptance of the order, JLRA will send the Customer an email to the registered email address summarising the essential elements of the order. This email will include an itemized tax invoice.

JLRA is not obliged to carry out any incomplete or inexact orders or orders placed with different methods to those established in these General Conditions.

Confirmation that your goods have been dispatched will be sent via email to the registered email address. The email will include an Australia Post tracking number.

To provide excellent customer service, JLRA processes orders upon receipt. If you change your mind once your order has been submitted please return the package using the process outlined under our ‘Returns Policy’ and on your delivery letter or contact the JLRA Information Centre on 1300 882 610 or via email to info@jaguar-merchandise.com.au for assistance.

In the event that the products ordered by the Customer are not available, JLRA undertakes, to notify the Customer of the lack of availability as soon as is practicable and to refund the Customer any sums already paid within 30 days of such notification.

Deliveries are carried out on behalf of JLRA by Australia Post. Generally, delivery takes place within 14 days of the date on which the order is accepted by JLRA.

Whilst we will do everything possible to deliver your goods by the day specified, we cannot accept liability for deliveries made outside the stated schedule. In the event however that your order is not delivered within 30 days of the date of ordering, you may cancel your order and receive a full refund of all monies paid by contacting the JLRA Information Centre on 1300 882 610 or via email to info@jaguar-merchandise.com.au.

JLRA will deliver all parcels directly to your nominated address within Australia via Australia Post. The standard delivery and packaging charge is $12.00 AU (including GST) per order regardless of the weight or content of the order.

On the rare occasions that an item is out of stock we may send part of your order separate from the out of stock item. The remaining items will be sent separately as soon as they become available. You will only be charged for items that have actually been sent to you, and you will only be charged one delivery and packaging charge regardless of how many parcels we send to fulfil your order.

When your parcel arrives, please check the contents against the enclosed invoice. In the unfortunate event that there are any discrepancies with your order please contact the JLRA Information Centre on 1300 882 610 or at info@jaguar-merchandise.com.au.

Payment Options

Payments can only be made via the PayPal payment system using a credit/debit card or a registered PayPal account. PayPal payments are processed by Destination Group of Companies PTY LTD on behalf of JLRA.

Your card will only be charged for items that have been dispatched, therefore, charges will appear on your statement once the items have been sent.

Returns Policy
This policy does not affect and is in addition to your legal rights under the Australian Consumer Law, as set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth) (ACL), and any other applicable legislation or regulation.

Details of the JLRA Satisfaction Guarantee Warranty Policy can be found below. Please follow the returns policy instructions when making a return. Every delivery comes with an invoice listing the contents of the order.

Return Instructions:

  1. Please fill out the Returns Form enclosed in you order. We use the Returns Form to identify your order so it’s important that you include the completed form in your parcel so we can replace the item or refund you for the item.
  2. Your parcel will include an Australia Post Return Paid envelope, postcard, coupon or self-mailer including a Return Paid number.
  3. Simply take your parcel quoting the return paid number to your local Australia Post Office and return it to the above address.
  4. You will not be charged for the return.
  5. All returns must be in their original condition and include the original product packaging
  6. Whenever you return goods to us, please try as far as possible to take care when opening the delivery bag, parcel or box. If you are able to return them in their original delivery bag, parcel or box, this may save you having to buy alternative packaging in which to return the goods.

Our home approval period is 14 days from receipt. Except where required by the Australian Consumer Law or other applicable consumer protection legislation, the following goods are not eligible for return unless faulty:: (i) goods which have been made to your specifications or clearly personalised, (ii) items that are liable to deteriorate or expire rapidly, (iii) audio and video recordings and computer software that have been unsealed and/or used, and (iv) items that have been opened, used, are not returned in the original packaging or are not in a re-saleable condition.

To the extent permitted by law, (i)return of goods made by you outside this period may not be accepted by us and may be returned by us to you at your own expense; and (ii) delivery and return charges will only be accepted by JLRA where the goods are faulty or are returned within the home approval period.

JLRA Satisfaction Guarantee

In addition to any rights you may have under the ACL, should any item fail to give reasonable wear due to either defective workmanship or materials within 12 months from the date of purchase, we will, at our own discretion, repair, or replace the item, or credit part or all of the purchase price to the credit/debit card used to make the purchase. Please refer to the “Warranty Policy” section below for further details on how to make a claim.

This warranty does not affect, and is in addition to the rights and remedies available to you under a law in relation to the goods and services to which this warranty relates.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Refunds
If you are returning goods for a refund rather than replacement, the card adjustment will be made directly to your credit/debit card account within five working days of receipt of the goods by us. If returned goods do not show as a credit on your next statement, please wait until the following statement before contacting the JLRA Information Centre for assistance on 1300 882 610 or via email to info@jaguar-merchandise.com.au.

Warranty Policy

We at JLRA want you to be completely happy with your product. It has been designed and manufactured with as much care, attention to detail and quality control, as our vehicles.

  1. What the warranty does and does not cover

Our warranties cover every type of malfunction or defect that may appear in your much loved Jaguar Land Rover branded item within 12 months of purchase.

All goods are subject to fair wear and tear such as plated finishes, stitching, material, leather, metal and plastic.

The guarantee excludes general wear and tear and damage caused by accident, misuse or neglect, and does not cover the following:

  • Damage caused by faulty installation
  • Damage caused by not following the manufacturer’s care instructions
  • Damage caused by inappropriate cleaning products or those of a corrosive and/or abrasive nature (see user instructions)
  • The product being used for a purpose other than intended by the manufacturer.
  • This list is not exhaustive.

In the interests of continuous product improvement JLRA reserves the right to alter this Warranty Policy as necessary.

  1. What is our standard period of coverage?

Our standard product warranty is valid for a period of 12 months from the date of purchase.

Your warranty may be transferred to another person in a one-time transfer. This transfer is to allow the purchase of gifts where the ownership of the product is passed from one person to another.

  1. What you should do in the event of a warranty service?

We hope that our products bring you years of joy and satisfaction, however we appreciate things may go wrong. In the event that you find that our products require a warranty claim you should take the following steps:

  1. Contact the JLRA Information Centre on 1300 882 610 or at info@jaguar-merchandise.com.au
  2. Supply details of the warranty claim which include your personal details.
  3. JLRA will supply an Australia Post Return Paid number
  4. Simply take your parcel quoting the return paid number to your local Australia Post Office and return it to the address below.

  5. You should include details of when and where you bought the product and a copy of your receipt or online order number.
  6. You may be given a returns identification number, please include this number within the package and take note of this for your own reference.
  7. Retain the proof of postage/carrier return.
  8. Subject to inspection and in line with our fair wear and tear policy above we will repair, replace or refund in line with what you may have requested at the time of contact with us.
  1. What your warranty does not cover.

In addition to the conditions above, JLRA will not cover the following:

  1. Labour charges
  2. Consequential damages (the costs of repairing or replacing other property that is damaged when the warranted product fails
  3. Incidental damages (the costs a consumer incurs in order to obtain warranty service, such as telephone charges, time lost from work, transportation costs, and the cost of renting a product temporarily to replace the warranted product).

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state as well as country by country.

Privacy Disclosure

JLRA collects your personal information in order to enter into, and fulfil, transactions on this website or otherwise to deal with any request or query that you may have and if all or part of the information is not collected by JLRA, we may not be able to provide you with the relevant product, service or information.

Your personal information may also be used by JLRA and may be passed on to its group and affiliated companies, associates, agents, dealers, sub-contractors and licensees (which may be overseas such as in the US and UK) to advise you of products, services and special promotions undertaken by these organisations on behalf of JLRA. Availability
The goods and services featured on this website are only available to persons resident in Australia. JLRA will not accept orders from outside Australia.

All products and services are subject to availability and may be withdrawn at any time. All orders are accepted on the condition that the laws of New South Wales and the exclusive jurisdiction of the Courts of New South Wales apply to all such accepted orders.

Important notice about knives
It is against the law to sell to people under 16 years of age, knives and certain other articles with a blade or point made or adapted for causing injury. These products cannot be purchased by any person under 16 years of age.

Intellectual Property
All product and company names and logos referred to on the website are the trademarks, service marks or trading names of their respective owners including JLRA. You may download material from the website for the sole purposes of placing an order with us or using our website as a shopping resource. However you may not modify, copy, reproduce, republish, upload, post, transmit or distribute by any means or in any manner any material or information on or downloaded from our website without our prior written consent except where expressly invited to do so.

JLRA does not make any representations whatsoever about any other websites which you may access through our website or which may link to our website. We have no control over the content or availability of any websites linked to ours. In addition, a link to any other website does not mean that JLRA endorse or accept any responsibility for the content or the use of any such linked website and we shall not be liable for any loss or damage caused by or in connection with use of or reliance on any content, goods or services available on or through any other website or resource.

Liability
You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use our website and is compatible with our website. We cannot guarantee or warrant that any material available for downloading from our website will be free from infection, viruses and/or other code that has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.

We accept no liability for loss or damage suffered by you arising out of or in connection with the viewing, use or performance of our website or its contents other than as a direct result of your purchasing goods, except where we have been negligent

The limitations and exclusions in this clause do not affect your statutory rights and only apply to the extent permitted by applicable law.

General
We may alter these terms and conditions from time to time and post a revised version on our website following which all use of our website will be governed by that version. You are advised to check the terms and conditions of the website regularly.

If any provision or term of these terms and conditions shall become or be declared illegal, invalid, void or unenforceable for any reason whatsoever such term or provision shall be severable from the other terms and conditions and shall be deemed to be deleted from them. The validity, legality and enforceability of the remaining provisions or terms shall not in any way be affected or impaired thereby.

These terms and conditions do not confer any rights on any person or party other than you and/or JLRA.
